The purpose of the system; system organisation
The Dynamic Purchasing System that will be entered into is broad and is intended to be used for spatial planning, administration and management, design and regulation, control, and preparation of tender documents.
Bergen Municipality excludes extremely complex and demanding assignments from the DPS, for example, comprehensive, advanced and complex engineering design assignments or assignments requiring advanced expertise in special competence areas. By using the DPS for tender implementation, Bergen Municipality will also see which companies are included in the system, and how these can be expected to have the necessary competence.
Contracts for construction manager assignments, less complex engineering design assignments will be announced within the DPS. Further assignments of less complexity, for example, inspection of civil engineering execution or condition assessments.
Scope of the system
The system includes consultancy and advisory services in all technical building disciplines as well as architect services (Architect and Landscape Architect). This can for example apply to:
— engineering design for building and construction;
— project administration in building, construction and property;
— construction management;
— builder representative;
— reviews, mapping, condition assessments and analysis connected with the building and construction sector as well as installations;
— ground surveys;
— regulation work, including preparation of zoning plans;
— spatial planning, amongst other things, within traffic, cultural monuments, transport (roads, rail, ocean);
— civil engineering inspection/independent inspection;
— consultancy and advisory services related to lighting and acoustics;
— preparation of technical tender documents for building and construction related procurements.
The contracts in the Dynamic Purchasing System will usually be based on the standard templates NS 8401, NS 8402 or NS 8403, depending on which standard is best suited to the assignment.
Ordering authorities at the contracting authority
The Dynamic Purchasing System will apply for all of Bergen Municipality and all their entities. The following municipal entities and units are currently relevant ordering authorities:
— Agency for Urban Development,
— The Building and Property Department,
— Agency for Buildings and Property,
— The Agency for Water and Sewage,
— Bergen Vann KF [Bergen Water],
— The Agency for Urban Environment,
— The Agency for Sport,
— The Agency for Planning and Building Services.
Overlapping and supporting contracts
Bergen Municipality currently has a number of framework agreements for the service areas listed previously. These contracts will exist alongside the Dynamic Purchasing System that Bergen Municipality where there are framework agreements binding Bergen Municipality to purchase within the contracts, these will be utilised. The dynamic purchasing system will thus not be able to lead to so-called contract leaks, but will supplement, and in the long run within some areas be able to replace framework agreements entered into. The system will not be time limited.
Furthermore, moving forward, Bergen Municipality also wants to be able to choose to announce individual procurements outside of the Dynamic Purchasing System. This can for example concern extremely comprehensive contracts and contracts that require special expertise, cf. the above-named complex assignment.
All interested tenderers can apply to be qualified and included in the Dynamic Purchasing System.
The suppliers who are included in the Dynamic Purchasing System there will be little risk and little work involved in seeking inclusion in the system. At the same time, one will be notified when contests are held in the system. Therefore, Bergen Municipality advises interested suppliers to seek inclusion.
The contracting authority envisions that the suppliers can cover the different areas within the announced DPS, but there will not be a need for all of the contracting authorities who qualify for the system to cover all areas. This means that not all who are qualified in a DPS can expect to submit tenders in a tender contest. Bergen Municipality recommends however, that companies included in the system assess each announced assignment in relation to whether they have the opportunity to submit a tender offer.
The system duration can be expanded and shortened by the contracting authority by a separate announcement to this effect, cf. the procurement regulations § 26-5(3).
Section III: Legal, economic, financial and technical information
Tenderers must be a legally established company.
Documentation: tenderers registered in the Norwegian Register of Business Enterprises do not need to enclose documentation. The contracting authority will inspect the registration by using the organisation number provided in the tenderer's Mercell profile. For tenderers that are not registered in the above-mentioned register, the tenderer must provide certificates or confirmation of registration (equivalent to a company registration certificate) in a trade register or company register as described in the legislation in the country where the tenderer is established. The certificate must not be issued more than 6 months prior to the tender deadline.
Tenderers must have substantial and relevant experience. The experience must include deliveries of comparable complexity as the delivery requested in the Dynamic Purchasing System.
Documentation requirement: relevant experience is to be documented by stating a minimum of three (3) and a maximum of five (5) reference projects from the last three (3) years. Information on this point is to be given in Mercell. Only the first five projects will be assessed if more than five reference projects are listed.
Bergen Municipality would like to enter into contracts with service providers who have top professional competence and a good ability to fulfil the assignments that are included in the system.
Documentation: a general description of the tenderer's general areas of competence, an overview of number of available HR per competence area and information of relevant certifications for the tenderer's HR.
Tenderers must have adequate competence and professional qualifications for managing and quality assuring the assignment. Documentation: the tenderer must attach an overview of the experience and professional qualifications hold by managerial group and/or key personnel that are responsible for the assignment.
